This Petition under Section 482 Cr.P.C. has been filed by the Petitioners assailing the Order dated 23.05.2016 in FIR No.322/2016, under Sections 420/467/468/471/120B IPC, registered at Police Station Model Town, Delhi, vide which learned learned Metropolitan Magistrate has directed the registration of FIR on an Application under Section 156(3) Cr.P.C.

Learned Additional Public Prosecutor for Respondent-State on instructions submits that the FIR was duly registered on 30.05.2016 and investigation has been duly carried out and the charge-sheet has already been filed before the learned Metropolitan Magistrate. Petitioners have failed to appear and the proceeding under Section 82 Cr.P.C. has been initiated against them.

In view of the aforesaid and the fact that Charge-Sheet stands already filed, any grievance of the Petitioner would have to be addressed at the relevant stage before the learned Metropolitan Magistrate. 4.
In light of above, the present Petition and pending Application are dismissed as infructuous as well as for non-prosecution.
