Petition under Section 482 of the Code of Criminal Procedure, 1973 (in new Code Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023) (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioners, for quashing of FIR No. 200/2019 under Section 308/305/54 of the Bharatiya Nyaya Sanhita, 2023, registered at Police Station Dayalpur and all the consequential proceedings emanating therefrom, in view of the Compromise Deed dated 30.04.2025., 4.

On advance Notice, learned APP has appeared and accepts the Notice on behalf of the State.

Brief facts of the case are that the Petitioners and the Respondent No. 2 are family relatives. The Respondent No. 2 run a hotel, namely, RAJA Hotel, near Masjid, Old Mustafabad, Delhi-94. Around two years ago, a boy, namely, Azim harassed his sister, namely, Nisha, aged 13 years old. On 22.05.2019 at about 10:00 p.m, Azim along with his brother, namely, Rashid Suhel, Sajid and two other boys came from the front with sticks and iron rods in their hands and stopped the Complainant and started beating him. Resultantly, Respondent No. 2 become unconscious and the Petitioners ran away. Aftab Uncle admitted the Respondent No. 2 to Jag Pravesh Hospital. Thereafter, the Respondent No. 2 got discharged from the hospital. 7.
On the Complaint of the Respondent No.2/Complainant, FIR No. 200/2019 under Section 308/305/54 B.N.S., got registered at Police Station Dayalpur.

Learned counsel for the Petitioners, submits that the Respondent No. 2 has already deposed in the Court that he has not been able to identify the Petitioners.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement Compromise/Mutual Settlement dated 30.04.2025 In the Settlement, it was inter alia settled between the parties that the Petitioners shall pay a sum of Rs.50,000/-, to the Respondent No. 2 in cash. It is also submitted that the Respondent No.
shall withdraw all his Complaints/FIR/Suits, if any, pending against the Petitioners. It is also settled between the parties that they shall not litigate in future. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Today, the Respondent No. 2, who is present in the Court, states that he has received all amounts due to him and has no objection if the said FIR is quashed.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature and the gravity of the offence, no case is made out for quashing the FIR No. 200/2019 under Section 308/305/54 B.N.S., got registered at Police Station Dayalpur and the consequential proceedings emanating therefrom.
