The present suit seeks partition of property 'No. 5A, measuring 311 square yards and comprising Khasra Nos. 205, 206, and 211, located at Govind Mohalla, Village Haidarpur, Delhi'. The suit property was stated to be purchased from the income of the family business headed by the Plaintiff in the name of his late wife, Smt. Chitra Gupta, who died intestate on 11th November 2020. Consequently, as per the plaint, all parties have a share in the property, but the Defendants have not agreed to partition despite the Plaintiff's requests.

Vide order dated 30th November, 2021, this Court directed status quo to be maintained in respect of the suit property. On 23rd August, 2023, as per the ld. Joint Registrar, Defendant no. 1 was deemed to have been served, and Defendant No. 2 was duly served. Vide order dated 6th March, 2024, this Court the Defendants to be proceeded ex-parte. 4.

Today, Mr. Singhal, ld. Counsel submits that he has instructions to withdraw the present suit.
