This is a petition seeking execution of the decree sale deed in respect of land 41 Bighas 16 Biswas comprising in Khasra no.5/22(2-3), 23(3-18), 13(4-5), 14(1-0), 8(1-8), 7(2-8), 18(4-15), 16(1-4), 25(0-6), 6/11(2-10), 20(3-1), 21(4-3), 5/6 min (2-8), 15(4-5), 6/10(0-17) situated at Revenue Estate of Village Singhola, Delhi in terms of order dated 04.02.2020 passed in CS(OS) No. 270/2019.

It is stated by Mr Khatri, learned counsel for the judgment-debtor that the consolidation in respect of 7 Bighas 10 Biswas was cancelled by the Financial Commissioner and the judgment-debtor has challenged the same by filing W.P. (C) 481/2021 which is pending adjudication. De-hors the same, the judgment-debtor is ready and willing to execute the sale deed on „As Is Where Is‟ basis in favour of the decree-holder. The same is acceptable to decree-holder - Mr. Ashok Kumar, who is present in Court today along with counsel.

The judgment-debtor will approach the concerned ADM for obtaining No-Objection Certificate (NOC) for execution of sale deed in favour of the decree-holder. On receiving the NOC, the sale deed will be executed within two weeks thereafter.

Taking the statement of Mr Khatri, learned counsel for the judgmentdebtor on record and binding the judgment-debtor to the same, the present petition is disposed of.

Liberty is granted to the decree-holder to revive the present petition in case the order passed today is not complied with in letter, spirit and intent.
