By way of the present petition, the petitioners seeks quashing of the FIR bearing No. 76/2023, registered at Police Station Swaroop Nagar, Delhi, for the commission of offences punishable under Sections 363/376/506 of the Indian Penal Code, 1860 (hereafter 'IPC') and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act') and all consequential proceedings emanating therefrom. 2.

Brief facts of the case are that the present FIR was registered by the mother of the victim on 13.01.2023, stating that her 16-year-old daughter "C" had been missing since 08.01.2023. Subsequently, on 25.01.2023 a PCR call bearing DD No. 38A was received at the Police Station Swaroop Nagar, wherein an advocate informed that the accused along with two more boys had been kept in confinement by the family of the girl in their house. Consequently, the police had reached the residence of the victim where the victim was found present with her family members. Her statement was recorded under Section 164 CrPC, wherein she stated that she was in a relationship with the accused for the past four years and on the day of Raksha Bandhan he took her to his house and established physical relations with her.

Further she stated that she informed her family about the same, whereupon her parents called the parents of the petitioner and had asked parents had asked the parents of the petitioner to transfer a plot in her name to ensure that the petitioner does not refuse to marry her in future. Further it is stated that the family of the petitioner filed a false complaint against her family that he had been kept in confinement. It is stated that with intervention of the family and friends, the parties have now amicably settled their dispute between themselves. It is further stated that the petitioner and the victim are major and have been residing together as husband and wife since October, 2024 and are also blessed with a child. 5.

entered into compromise out of their own free will and without any pressure, coercion or threat. It is also stated that the petitioner and the victim have been living together since October, 2024. Therefore, they have no objection if the present FIR is quashed.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 7.

Accordingly, FIR bearing No. 76/2023, registered at Police Station Swaroop Nagar, Delhi, for the commission of offences punishable under Sections 363/376/506 of IPC and Section 6 of POCSO Act and all consequential proceedings emanating therefrom are quashed. 8.

Accordingly, the present petition stands disposed of. 9.
