The petitioner has filed the present petition, inter alia, seeking bail in connection with FIR No.0050/2016 under Sections 363/367/368/372/373/34 of the IPC, registered with PS Swarup Nagar. The allegation against the petitioner is that he is a part of a conspiracy wherein a child of one and a half years of age was picked up with the intention of selling him. The petitioner was apprehended on the basis of a secret information, along with two other co-accused.
The child was also rescued on the basis of the disclosure made by other co-accused. It is alleged that a mobile phone was recovered from one of the co-accused and the same had a picture of the said child. The said co-accused (Vijay Singh) had stated that the said phone was handed over to him by the petitioner herein.

The learned ASC states that material witnesses are yet to be
examined. Given the serious nature of the offences and given the stage of the trial, this Court does not consider it apposite to allow the present petition.

At this stage, the learned counsel appearing for the petitioner seeks to withdraw the present petition.

The petition is dismissed as withdrawn.
