This petition is filed under section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator to adjudicate the disputes between the parties. It is the case of the petitioner that on 24.4.2015 it entered into a Non-Disclosure Agreement with the respondent. Thereafter on 1.5.2015 the parties entered into a collaboration agreement on 1.5.2015. It is urged that clause 11 of the said agreement provides for arbitration in case of dispute between the parties. It is urged that the arbitration clause has been invoked on 22.12.2016 by sending two letters via registered AD and served on the respondent.

Respondents are served. Despite service, none has appeared for the respondent. Respondent is proceeded ex-parte. In terms of the Strategic Collaboration Agreement dated 1.5.2015 Clause 11 provides that in case of dispute between the parties the parties shall try to amicably resolve the matter. If the matter is not amicably resolved disputes shall be referred to an Arbitrator.

Keeping in view the arbitration clause, Shri S.P. Kamrah, Advocate (Mob.9810610466) is appointed as a Sole Arbitrator to adjudicate the dispute between the parties. The arbitration shall be held under the aegis of Delhi International Arbitration Centre.

Petition stands disposed of. All pending applications, if any, also stand disposed of.
