First Interim Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the Petitioner, Radhey Shyam for grant of Interim Bail for medical treatment for one month from the date of his release in Case FIR No. 94/2021 under Section 420 of the Indian Penal Code, 1860 registered at Police Station Greater Kailash. 4.
It is submitted that in the present FIR, out of 60 Lakhs that were due to the Complainant, Rs.45,00,000/- were paid but because he was unable to arrange the balance amount of Rs.15,00,000/-, he did not appear in the Court and warrants were issued in the interim. Cases bearing FIR No. 197/2023 under Section 354/323/509 IPC and Section 10 and 12 of POCSO Act, registered at Police Station Parshant Vihar and FIR No. 54/2017 under Section 420 IPC, registered at Police Station Kamla Market.

It is further submitted that he is suffering from medical ailment and is not getting proper treatment. He has already been granted Interim Bail on medical reasons in the aforesaid two FIRs. It is, therefore, submitted that he be granted Interim Bail for a period of one month. 6.
The Medical Status Report was submitted on 24.03.2025 gave details of the complications being suffered by the Petitioner. Cystoscopy Test was recommended, which has not been done till date. 7.
Considering the medical condition of the Petitioner, he is granted Interim Bail for a period of one month from the date of his release, on the following terms and conditions:- a) The Applicant/Petitioner shall furnish a personal bond in the sum of Rs.30,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court.
b) The Applicant/Petitioner shall not leave Delhi/NCR without prior permission of the Court;
c) The Applicant/Petitioner shall provide his mobile number and also the mobile number of his surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating Officer concerned; d) The Applicant/Petitioner shall inform the IO/Jail Superintendent, the address where he shall be available in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

e) The Applicant/Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses.
f) The Applicant/Petitioner shall not stay near the complainant and shall not threaten the complainant and the other witnesses in any manner.
g) Upon expiry of period of one month, as stated above, the Applicant/Petitioner shall surrender before the concerned Jail Superintendent.
