Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of the FIR No. 0415/2023 dated 21.12.2023 registered under Section 174A of the Indian Penal Code, 1860 at P.S. New Friends Colony and all proceedings emanating therefrom.

Learned Prosecutor takes an objection as the charges under Section 174A IPC have already stand framed on 09.01.2025 wherein it is observed that there is no contest on the point of charge once the charges are framed and the Petitioner is at liberty to disprove the case of the prosecution by way of evidence. Even otherwise, the Revision should have been filed by the Petitioner instead of coming to this Court.
