Present petition has been filed on behalf of the Petitioners under Articles 226/227 of the Constitution of India read with Section 482 Cr.P.C. seeking the following relief:- "a. Issue the mandamus writ thereby directing the respondents no. 2 to file the preliminary inquiry report which should be made time bound and in case of delay exceed 7 days, with the causes of it reflected in the General Diary entry in accordance with the judgment of "Lalita Kumari Vs State of UP";"

Learned counsel appearing on behalf of the Petitioners seeks to withdraw the present petition as the petition is rendered infructuous, in view of the fact that the Petitioners have already taken recourse to the appropriate remedy under Section 156(3) Cr.P.C.
