O R D E R

% 26.07.2024 I.A.34499/2024 (joint application under Order XXIII Rule 3 CPC for withdrawal of suit in terms of settlement dated 16.07.2024 arrived between parties before the Mediation Centre, Delhi High Court) 1.

The present suit for recovery has been filed by the plaintiff. 2.

During the pendency of the suit this Court vide order dated 12.03.2024 had referred the matter to the mediation, where the parties had arrived at settlement, terms whereof have been reduced in writing in the form of settlement agreement dated 16.07.2024. 3.

The agreement is signed by the defendant no. 2 in his own capacity as well as in his capacity as Special Attorney of other defendants. The said settlement agreement is annexed to the present application. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. In terms of the said settlement it has been agreed that the defendants shall pay full and finally settled amount of Rs. 63,00,000/- to the plaintiff. 5.

Out of the said amount, a sum of Rs. 6,30,000/- has already been paid at the time of signing of the settlement. The balance amount of Rs. 56,70,000/- has been paid today in Court by the defendants to the plaintiff by way of demand draft bearing No. 052032 dated 26.07.2024 issued by The Nainital Bank Ltd.

The present application is also signed by the parties, as well as, their respective counsels. The authorized representative of the plaintiff and the defendant no. 2, who also holds an attorney of other defendants, affirm having entered into the settlement.

The plaintiff also acknowledges having received the full the final settlement amount.

In view of the above, there is no impediment in disposing of the suit in terms of the settlement.

Accordingly, the application is allowed and the suit is disposed of in terms of the settlement.

All the pending applications also stands disposed of. 11.

Since the parties have arrived at settlement before the Delhi High Court Mediation & Conciliation Centre, the Registry is directed to issue a certificate to the plaintiff for the refund of full Court fee affixed on the plaint.
