% 14.05.2025 CRL.L.P. 145/2021 1.

A Petition under Section 378(3) Cr.P.C for Leave to grant Appeal has been filed on behalf of the Petitioner challenging the impugned Judgment dated 06.02.2020 passed by learned MM, Rohini Courts, Delhi. 2.

Learned APP submits that there were as many as three eye witnesses who have been examined, who have corroborated the incident, despite which their testimony has been disbelieved on the ground of contradictions. Hence the Leave to Appeal is sought.

Considering the submissions made and the averments in the Leave to Appeal Petition, the same is allowed.

Learned counsel for the Respondent has appeared through Video Conferencing and submits that he has only come to know yesterday about the case. Though the Respondents were served earlier and were appearing regularly.

On the request of learned counsel for the Respondents, who states that he shall appear physically in the Court, list the matter tomorrow i.e. 15.05.2025.
