O R D E R

% 28.01.2019 The petitioner is present in Court in person with his counsel Mr.Tungesh, whose Vakalatnama is on record. Learned counsel for the respondent Mr.Sunil Dalal states that they have also filed their Vakalatnama on record.

Both the counsels state that the parties have arrived at a settlement, whereunder the amount deposited in terms of order dated 17.07.2017 of Rs.3 Lakhs, which is lying in a fixed deposit in this Court, be released to the respondent along with accrued interest and on receipt of the said amount, the debt owed to the respondents shall stands fully satisfied and the respondent shall release security of the immovable property held by it to the petitioner. Let the amount deposited in this Court in terms of the order dated

17.07.2017 be released to the respondent along with interest accrued thereon forthwith.

List the matter before the Joint Registrar on 18.02.2019 for the purpose of recording the receipt of the amount by the respondent and release of the security documents to the petitioner. The writ petition, otherwise, stands disposed of.
