O R D E R

% 26.08.2019 Vide the present petition, the petitioner seeks bail in FIR no.79/2017 registered at PS Dwarka, New Delhi, for the offence under Sections 458/389/397/412/120B IPC.

Learned counsel for the petitioner submits that there is no recovery from the petitioner and he has not been seen in the CCTV footage and for the last two and half years, he is in jail.

Learned Additional Public Prosecutor for the State on the other hand submits that the petitioner was waiting outside the school in Alto Car which is in the name of his father. He has further submitted that other six persons entered the school and robbed Rs. 25000/- and some stationary with stamps of the school. The recovery has been made from the accused Babloo and accused Sunil. However, no recovery is made from the petitioner.

Keeping in view the facts that there are three accused persons absconding and accused Babloo has already been released on bail and the petitioner is in jail from last two and half years, I am of the view that the present case is fit for bail.

Accordingly, trial court is directed to release the accused/petitioner on bail on furnishing of bail bond of Rs. 10,000/- and two sureties in the like amount with its satisfaction.

Application is accordingly allowed.
