Petitioner is defending a suit for possession and recovery and while defending the abovesaid suit, he has also filed a counter-claim. 2.

He wanted the additional issues to be framed in the main suit and also wanted some amendment in his counter-claim.

Fact, however, remains that the present petition has been filed assailing the dismissal of his application moved under Order VI Rule 17 CPC whereby he was seeking amendment in his counter-claim. 4.

After hearing arguments for some time and without prejudice to his rights and contentions with respect to the other request regarding framing of additional issues in the main suit, learned counsel for petitioner does not press the present petition.

Petition is, accordingly, dismissed as not pressed. 6.
