% 09.02.2018 Leaned counsel for the petitioner seeks permission to withdraw the present writ petition and states that he would impugn the directions given in the order dated 08.01.2018 passed by the Additional Commissioner (OHA), Value Added Tax, Delhi before the Appellate Tribunal.

Learned counsel for the petitioner states that they have already filed an appeal against the said order. The said appeal would require an amendment incorporating additional grounds. 3.
In case any application for amendment is filed within a period
of 15 days from today, the same would be entertained and would not be dismissed on the ground of delay, limitation or on technical grounds.

Learned counsel for the petitioner states that they would also move an application for stay as the Assessing Authority is proceeding on the basis of the directions. In case any stay application is filed the same would be considered by the Appellate Tribunal in accordance with law.

With the aforesaid observations, we accept the statement made by the counsel for the petitioner and the writ petition is dismissed as withdrawn with liberty as prayed for. We have not commented on merits.
