O R D E R

% 28.05.2025 1.

The learned Senior Counsel for the petitioner, at the outset, seeks liberty to withdraw the present petition and submits that since the matter is listed before the learned Trial Court for arguments on charge, he shall take all arguments before the learned Trial Court.

He submits that the petitioner is an old lady aged 66 years and has been implicated solely for the reason that she is the mother of the complainant's husband.

He submits that the complainant and petitioner's son had a love marriage and that they never stayed with the petitioner. He consequently submits that only because the complainant and her husband have a matrimonial dispute, the same cannot be a ground to drag the petitioner in the case.

complaint under the Protection of Women from Domestic Violence Act, 2005 and that no allegations had been made against the petitioner in regard to any domestic violence being inflicted.

He submits that since the petitioner is 66 years old and has been implicated without any evidence, she may be exempted from personal appearance.

Considering the above, the present petition is dismissed as withdrawn with liberty to the petitioner to take all arguments before the learned Trial Court at the time of arguments on charge.

The learned Trial Court is directed to pass an order without being influenced by the filing of the present petition or any observations that have been made in the present order. 8.

Considering the nature of the dispute, the petitioner is also exempted from personal appearance unless the learned Trial Court finds the same to be necessary.

The learned Trial Court is, thus, requested to allow the application filed by the petitioner seeking exemption from personal appearance.

The petition is disposed of with the aforesaid observations. 11.
