The grievance of the Petitioner as articulated in its prayers is set out below:

"a) issue a writ of mandamus or certiorari or any other appropriate, writ or direction which this Hon'ble Court may deem fit be issued in favour of the petitioner and against the respondents whereby the respondents be directed to ensure that no encroachments on the public land / passage as shown in red colour (Annexure P-2) to the present writ petition take place by any local residents including Sh. Sunil Kumar Tanwar and Sh. Dharampal Singh. b) direct the respondents to cover the land in question by fencing or making a boundary wall and to do all other necessary acts to see the proper utilization of this land.

c) Cost of the present proceedings may be awarded in favour of the petitioner."

On the last date of hearing, learned Counsel for the Petitioner, on instructions contended that the land in issue is public land and is being encroached upon by third party. Thereafter, on instructions, the learned Counsel for the Petitioner had restricted his prayers in the present Petition to prayer (a).

Learned Standing Counsel for the Respondents submits that in the event that the land is public land, the Respondent Nos.1 to 3 shall take appropriate steps to ensure that no encroachment on the public land takes place.

3.1 The Respondents are bound down by the statement made by learned Standing Counsel.

The Petition is disposed of in the aforegoing terms. Pending Applications stand closed.
