The present petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the Petitioner assailing the Order dated 23.05.2025 passed by the learned ASJ, Special Fast Track Court, South District in case bearing SC No. 335/2023 arising out of FIR No. 590/2021, registered at police station Ambedkar Nagar, Delhi and all consequential directions arising therefrom.

The learned Senior Counsel submits that pursuant to the Order dated 28.05.2025, notice has been served on the Respondent nos.2 & 3, however, since the time was short, the process fee could not be filed.

None has appeared on behalf of Respondent nos.2 & 3. 4.

listed before the learned Trial Court on 26.05.2025 and the learned Trial Court has issued a notice to the Petitioner (brother of the victim) to produce the original prescription of Lady Harding College & Smt S K Hospital, Connaught Place and original prescription of K.D. Multispecialty Hospital, Gurugram on 30.05.2025. He further submits that the matter is now listed for recording of the evidence of the prosecution witnesses on 08.07.2025 and for the said date of hearing, three witnesses, namely, HC Upender, SI Rahul and MHC (M) have been summoned along with these witnesses, he submits, that testimony of petitioner may be recorded.

The learned Senior Counsel, submits that the medical documents as has been directed by the learned Trial Court to be produced, will be submitted by the Petitioner i.e. brother of the victim through his counsel. He may be exempted from appearance before the learned Trial Court tomorrow.

In view of the above, the medical documents be produced before the learned Trial Court on 30.05.2025, as directed vide Order dated 26.05.2025 through the counsel. However, the learned Trial Court may issue a fresh summons to the petitioner(witness before the learned Trial Court) to appear on the said date of hearing, i.e. on 08.07.2025.

In terms of the above directions, the petition stands disposed of. 8.
