Application under Section 439 of the Code of Criminal Procedure, 1973 („Cr.P.C.‟) has been preferred on behalf of petitioner for interim bail in FIR No. 0216/2019 under Section 302 IPC registered at P.S.: Baba Hari Das Nagar for a period of 54 days for the purpose of marriage of his sister. 2.
Application is opposed by learned APP for State and it is urged that upon verification it has been revealed that sister of the petitioner is residing with her grand-parents since the parents of the petitioner have already expired. He further opposes the bail on merits since the petitioner is accused of murdering his step father. Learned APP further submits that date of marriage of sister of the petitioner has neither been fixed nor the particulars regarding the proposed groom have been shared. Further other family members of the petitioner are stated to be available for the purpose of marriage of sister of petitioner.

Considering the facts and circumstances, heinous nature of offence in which the petitioner is involved and the evidence on record, no grounds for interim bail are made out.
