Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 („BNSS‟) has been filed on behalf of the Petitioners, for quashing of FIR No.0462/2021 under Sections 341/324/34 IPC, registered at PS: Pul Prahalad Pur, Delhi and all consequential proceedings emanating therefrom, in terms of Memorandum of Understanding dated 19.05.2025. 2.

Learned APP for the State and learned Counsel for Respondent No. 2 appearing on advance Notice, accept Notice.

As per the FIR, Complainant / Respondent No.2 Rajesh Kumar was holding his tuition classes on at H No.GD-13, 1st Floor, Pul Prahalad Pur, when he heard ruckus being made below the building, which was creating a in his teaching. He came down and found some boys were present and when he objected to their creating ruckus, one of the boys with a pointed objected inflicted injuries to Respondent No.3 Kaif. Petitioner‟s name is mentioned, but he was only a by-stander.

It is further submitted that on 12.10.2021 on Complaint of Respondent No. 2, FIR No.0462/2021 under Sections 341/324/34 IPC was registered at PS: Pul Prahalad Pur, Delhi.

It is submitted that present FIR was a consequence of disputes between Petitioner No.1 and Respondent Nos.2 & 3 and all the disputes and differences between them, with the intervention of family members, relatives and well wishers, have amicably settled vide Memorandum of Understanding dated 19.05.2025.

The parties are present in the Court and have been identified by the IO. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Memorandum of Understanding dated 19.05.2025 with their wish and will. 7.

Learned Counsel for Petitioners submits that the parties have no grievance against each other. Since Respondent Nos.2 and 3 have already made a statement before the Court that they do not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0462/2021 be quashed.

In view of Memorandum of Understanding dated 19.05.2025, present Petition has been filed.

Respondent Nos.2 and 3 are present and submit that they have no grievance against the Petitioner and also no objection to the quashing of FIR. 10.

In view of the fact that the FIR in question was premised upon a dispute between Petitioner and Respondent Nos.2 and 3, which has been amicably resolved in terms of Memorandum of Understanding dated 19.05.2025.
