Plaintiff and the defendant no.1 have settled their disputes in terms of the written settlement agreement signed between them before the Delhi High Court Mediation & Conciliation Centre on 27.2.2018. This agreement satisfies the requirements of Order 23 Rule 3 of Code of Civil Procedure, 1908 (CPC).

Accordingly the suit is disposed of as settled and a decree be drawn in terms of the settlement agreement dated 27.2.2018 as between the plaintiff and the defendant no.1.

Plaintiff does not press this suit so far as defendant nos.2 to 4 are concerned.

Since the suit is disposed of by settlement before recording of evidence, it is ordered that plaintiff in terms of Section 16-A of the Court-Fees Act, 1870 (as applicable to Delhi) will be entitled to refund of 50% of the court fee paid. Registry will issue the necessary certificate in favour of the plaintiff.
