By the present petition, the petitioner seeks issuance of directions to the learned Family Court, North District, Rohini Courts, Delhi to expeditiously dispose of the execution petition being Ex No. 215/2022. The petitioner is essentially aggrieved that her execution petition has been pending from more than three years.

The present matter relates to the recovery of ad interim maintenance amount due to the petitioner.

The petitioner had filed a petition under Section 12 of the Protection of Women from Domestic Violence Act, 2005 ('DV Act'). The petition was also supported with an application under Section 23 of the DV Act.

The learned Family Court, by order dated 17.05.2022, had granted ad interim maintenance of ₹1,50,000/- per month to the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The petitioner claims that despite the said order being passed, no amount was paid to the petitioner which led to the filing of the execution petition on 17.12.2022. 6.

Undisputedly, almost three years have elapsed since the filing of the execution petition.

The execution petition relates to the payment of ad interim maintenance amount to the petitioner/ wife. The said petition, in the opinion of this Court, should have been decided expeditiously as the same relates to payment of maintenance to the aggrieved wife and which may be required for her sustenance. 8.

Thus, without going into the aspect of determining as to whose conduct had caused the matter to remain pending from almost three years, this Court considers it apposite to dispose of the present petition with direction to the learned Family Court to expeditiously pass substantive order in accordance with law. 9.

The learned Family Court is also directed not to give unwarranted adjournments to any of the parties. 10.
