This joint application is filed on behalf of the parties under Order XXIII Rule 3 read with Section 151 CPC for recording the settlement between them.

During the pendency of the suit, parties were referred to the Delhi High Court Mediation and Conciliation Centre, where they have amicably settled and resolved their disputes and executed the Settlement Agreement dated 07.02.2026 incorporating the terms of settlement, wherein Defendants have agreed to give up the impugned trademarks recognizing the proprietary rights of the Plaintiffs to the said trademarks as also the trade dress and have agreed to pay a sum of Rs.90,000/-, which learned counsel for the Defendants submits will be paid to the Plaintiff within four weeks from today.

Court has perused the terms of the settlement and finds the same to be lawful.

Accordingly, for the reasons stated in the application, the application is allowed recording the settlement between the parties in terms of settlement appended with the application.

This suit is filed on behalf of the Plaintiff seeking a decree of permanent injunction restraining the Defendants and all others acting on their behalf from infringing the Plaintiff's rights in the trade mark "LOOZ" and its formatives and from passing off, amongst other reliefs. 7.
The suit is decreed in terms of the settlement between the parties. Settlement Agreement dated 07.02.2026 shall form part of the decree and terms thereof shall bind the parties thereto. 8.
Registry is directed to draw up the decree sheet. 9.
Suit is disposed of along with the pending application. 10.
Plaintiff is held entitled to refund of entire court fees in accordance with the Court Fees Act, 1870.
