The present Petition under Section 482 Cr.P.C. has been filed by the Petitioner seeking quashing of FIR No. 125/2019, under Sections 328/376/506 IPC, registered at Police Station South Rohini, Delhi and the proceedings emanating from the Charge sheet filed in the present case. It is further sought to direct Respondent No.2 to file Final Report in regard to the Inquiry initiated pursuant to Order dated 29.04.2019 of the learned Session Judge, Rohini, in Bail Appl. No. 1134/2019 in 125/2019, under Sections 328/376/506 IPC, registered at Police Station Rohini. 2.

Parties are present in the Court.

04.12.2024, which is duly signed by both the parties. It is further submitted that this is fifth FIR registered by the Complainant with similar allegations. Respondents No. 4 & 5 are the erstwhile persons against whom earlier FIR was registered, to reflect that it is the modus operandi of the Complainant to make such Complaints and get the FIR registered. 4.

It is also stated that the Complainant is a qualified Doctor, who had been earlier employed in a Hospital in Etah, Uttar Pradesh. However, in Order to put a quietus to the pending litigations, the parties have arrived at a settlement whereby Petitioner has agreed to withdraw his Complaint of extortion against Respondent No.2 and the Complainant has agreed to withdraw the present FIR.

Respondent No.3 is present in the Court and she submits that she has endorsed the Settlement voluntarily and without any fear or coercion and shall remain bound by the terms of the settlement. In this Context it is also pertinent to observe that the Complainant on Inquiry, has stated that though she is a qualified Doctor but she has been under depression for which has not been able to place on record any document whatsoever. 6.

In view of the settlement and considering the nature of allegations in the present FIR, the present FIR No. 125/2019, under Sections 328/376/506 IPC, registered at Police Station South Rohini, Delhi, the Charge-sheet filed and the proceedings emanating therefrom, are hereby quashed. 7.

However, before concluding it is pertinent to note that this is fifth FIR registered on the Complaint of Respondent No.3. Apparently, it is the modus operandi adopted by the Complainant to make such Complaints and then all have been settled or ended in acquittal.
