Issue notice. The learned APP appearing for the State accepts notice. 3.

The petitioner has filed the present petition seeking bail in respect of FIR No. 929/2014 under Section 498A/406/34/174A IPC. 4.

The learned APP states that the matter is now listed for recording of evidence on 30.08.2019.

The facts, as obtaining in the present case, indicate that the petitioner

had been declared a proclaimed offender and was apprehended after a period of four years from Raipur, Chhattisgarh. Apart from the petitioner, various other family members of the petitioner are also accused in the said case. 6.

It is the petitioner's case that he was not in contact with any of the family members and was not aware of the FIR lodged against the petitioner or any of the proceedings emanating therefrom. 7.

This Court finds it difficult to accept the aforesaid contention. Given the conduct of the petitioner, this Court is not persuaded to accept that the petitioner would make himself available for trial. 8.

In view of the above, the present petition is dismissed with liberty to the petitioner to apply afresh after completion of recording of evidence. VIBHU BAKHRU, J AUGUST 26, 2019 MK
