% 29.08.2019 Ms. Sonia Sharma, learned counsel appearing on behalf of the petitioner states that, the present habeas corpus petition has been rendered infructuous, in view of the circumstance that Mr. Suraj

Mishra is at liberty.

Ms. Sonia Sharma, learned counsel further prays leave to withdraw this petition with liberty to institute the appropriate proceedings, as may be available to the petitioner in law to seek redress for the alleged offences committed by officers of the Directorate of Revenue Intelligence and the Jaipur Customs (Preventive Branch).

Leave and liberty granted.

The present petition is dismissed as withdrawn with the aforementioned liberty, in accordance with law. Mr. Jaideep Malik, learned counsel appearing on behalf of Mr. Rahul Gupta makes an oral application to implead the latter as a party in the present habeas corpus petition.

We are of the considered view that, Mr. Rahul Gupta is neither a proper nor a necessary party in the facts and circumstances of the case.

The oral application made on behalf of the learned counsel appearing on behalf of Mr. Rahul Gupta is devoid of merit and therefore rejected.
