This writ petition has been preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking a direction to the Respondent to regularise his services on notional basis on the post of Vehicle Driver, which is in the nature of 'service matter' as defined under Section 3(q) of Administrative Tribunals Act, 1985 and the relief is sought against Delhi Jal Board which is notified under Section 14 of the said Act. In view of the judgment of the Constitution Bench of the Supreme Court in L. Chandra Kumar v. Union of India and Others, (1997) 3 SCC 261, wherein it is held that in areas where the Administrative Tribunals have the jurisdiction, Tribunals will be the only Court of first instance, this writ petition cannot be entertained.

At this stage, learned counsel appearing on behalf of the Petitioner, on instructions, seeks to withdraw the present petition with liberty to approach the Central Administrative Tribunal.

Writ petition is disposed of as withdrawn with liberty as prayed for, in accordance with law.
