This petition has been filed seeking quashing of FIR No. 235/2013 registered at PS New Usmanpur under Sections 186/353/506/34 of IPC. 2.

Counsel for petitioner states that bare perusal of the FIR and the complaint, it is alleged that the petitioner by his words had threatened and abused the Labour Officers who had come who had come as part of the District Task Force, at his premises.

Aside from the fact, that the counsel for petitioner states that these allegations are baseless and incorrect, he contends that while Sections 186 IPC and 506 IPC are non-cognizable, Section 353 IPC, which is cognizable, is not made out since no force is alleged to have been used by the petitioner in this situation. APP for State, however, refutes the contention that force was not used.
