On the last date even though none was appearing for the petitioner, we had after perusal of the original record of the Summary Security Force Court (SSFC) proceedings prima facie observed that since the petitioner had not signed on the plea of ̳guilty', the writ petition deserved to be allowed in the light of the recent decision of this Court in W.P.(C) 665/2012 dated 14.08.2024 titled as ―Jai Pal vs. Union of India and Ors.‖. However, taking into account that the petitioner had rendered service for only about three and a half years before being dismissed from service during which period also he had been awarded a penalty of rigorous imprisonment, granted time to the learned counsel for the respondents to obtain instructions.

In these circumstances, we dismiss the writ petition in default and for nonprosecution in itself.
