By way of present petition, the petitioner seeks modification in the bail condition in the order dated 16.10.2023 passed by the Ld. Trial Court. 2.

It is averred in the petition that petitioner was admitted to bail by the Trial Court vide order dated 16.10.2023 subject to him furnishing personal and one local surety bond to the tune of Rs.50,000/-. Subsequently, the said condition was modified, vide order dated 06.02.2024, to the extent that amount of the personal and surety bond was reduced from Rs.50,000/- to Rs.20,000/-. The petitioner thereafter moved an application seeking waiver of the condition of surety bond of Rs.20,000/- stating that he is unable to arrange and furnish a surety. The said application came to be dismissed which is under challenge in the present petition. 3.

Issue notice.

Learned APP for the State accepts notice and, on instructions, states that petitioner's address has been verified.

Considering the fact that petitioner has not been able to avail the benefit of order dated 16.10.2023 passed by Ld. Trial Court, the said order is modified to the extent that petitioner shall be released on regular bail on his furnishing a personal bond in the sum of Rs.20,000/- with cash surety of the equivalent amount.

Petition is disposed of in the above terms alongwith miscellaneous application.

Copy of the order be communicated to the concerned Jail Superintendent for compliance.
