The present Petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the Petitioner seeking transfer of the investigation from Police Station Model Town, New Delhi to any other appropriate Agency in case FIR No.83/2021, under Section 420 IPC, registered at Police Station Model Town. 2.

It is submitted that there are recorded conversations between the Respondents and Investigating Officer to show that the things were being managed by the Respondents at the level of investigations. It is further submitted that no fair investigations are being carried in the present case and therefore, the investigation be transferred to an independent agency. Learned Additional Public Prosecutor for Respondent-State submits that Closure Report stands already filed before the Court of learned Metropolitan Magistrate.

In view of the above, no further directions are warranted in the present Petition. However, the contentions of the parties may be raised before the Court of learned Metropolitan Magistrate, who may consider the same independently.
