CRL.M.A. 27443/2024 (seeking modification of order dated 14.08.2024 by petitioner) 1.

By way of the present application, the petitioner seeks modification of order dated 14.08.2024 vide which the petitioner was released on a first spell of furlough for a period of three weeks upon furnishing of personal bond in the sum of Rs.10,000/ with one surety of the like amount. 2.

The application has been preferred through Legal Aid thereby contending that the petitioner at present is not in a position to arrange the surety for his release as directed by this Court and thus, prays that the said condition be modified with the personal bond/cash surety of Rs.10,000/-. 2.

On the last date of hearing, an objection was also raised as to the place where the applicant would reside once released. 3.

Learned ASC states that the petitioner's residence in District Bulandshahar, U.P. already stands verified.

Considering that the petitioner has not been able to avail the benefit of the order granting furlough, the order dated 14.08.2024 stands modified and the petitioner is directed to be released on furlough for the period specified on furnishing the cash surety of Rs.10,000/-. 5.

Copy of the order be sent to the concerned Jail Superintendent. 6.

Application stands disposed of.
