The present petition has been filed seeking following relief: "a. allow the petition under section 482 cr.p.c. seeking direction of this Hon'ble Court to the ld. metropolitan magistrate to expeditiously dispose of the interim application u/s 23 of the protection of women from domestic violence act, 2005 for grant of interim maintenance and interim reliefs filed by the petitioner along with the application under section 12 of the petitioner of women from Domestic Violence Act, 2005 within three months from the passing of the order by this Hon'ble Court in the present petition in ct. Case no. Mc 391/2023, titled 'Megha Vikas Sapra vs. Tarun Sapra & Anr.'

expeditiously decide the interim application under section 23 of the Protection of Women from Domestic Violence Act in MC 391/2023 within six months."

The learned counsel for the petitioner submits that the petitioner, alongwith the application under Section 12 of the Protection of Women from Domestic Violence Act, 2005, has also filed an application seeking interim maintenance under Section 23 of the DV Act.

She submits that the interim application has not been taken up for consideration despite the same having been filed as early as on May, 2023. 6.

She submits that the petitioner is a widow with two minor children. 7.

Considering the limited relief sought in the present petition there is no need for issuing notice in the present matter or to call for a reply. 8.

The petition is accordingly, disposed of by giving a direction to the learned Trial Court to decide the application of the petitioner under Section 23 of Protection of Women from Domestic Violence Act, 2005 expeditiously, preferably within a period of three months from today.
