It is noted that there has been no appearance on behalf of the Petitioner for last two dates of hearing. Even today, the position remains the same today. In such circumstances, the Court has proceeded to peruse the material on record, with the assistance of the counsel for Respondents. 2.

The instant writ petition has been filed seeking directions to provide sufficient time to the Petitioner to avail her legal remedies to challenge the order dated 28th July, 2023 passed by the Appellate Authority in the appeal preferred by the Petitioner against order dated 17th December, 2022, passed by the District Magistrate, South West District, New Delhi in Eviction Case No. 1/64/2021. The prayers sought in the petition are as follows: "A.

Issue a Writ in the nature of Mandamus or ceritori or of any other Writ/Writs, order/orders, direction/directions, whereby providing sufficient time period in favour of the petitioner to let her The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

exercise/avail her legal fundamental & constitutional rights to adopt appropriate legal recourse qua the order dated 28.07.2023 after receiving copy of the said impugned order, in the interest of justice.

Direct the respondent No.l to provide a certified copy of the order dated 28.07.23 to the petitioner to exercise/adopt her legal rights/remedies qua the same, in interest of justice. C.

Stay the operation of the impugned order dated 28.07.2023 till the time petitioner avails legal remedies/recourse qua the said order dated 28.07.2023 after receiving copy of the same from respondent no.l and/or.

D.

Pass any other order or direction as deemed fit and proper in the circumstances of the present case in interest of justice." 3.

In terms of directions issued on 6th September, 2023, Respondent No.1 has filed a status report on 12th September, 2023, stating as follows: "1.

The Petitioner has filed the present Writ Petition praying for directions to the Respondent no. 1 to provide a certified copy of the order dated 28.07.2023 passed in appeal against the impugned order dated 17.12.2022 passed by the District Magistrate, South West District, New Delhi in Eviction Case no. 1/64/2021 titled as Smt. Satya Verma & Anr. Vs. Sh. Tushar Verma & Anr., whereby the Petitioner herein was evicted from the said residence. 2.

In this regard, it is humbly submitted that the order in the appeal filed by the Petitioner against the impugned order dated 17.12.2022 by the District Magistrate, South West District, New Delhi in Eviction Case no. 1/64/2021 was only reserved for final order on 28.07.2023 and the order was finally pronounced on 30.08.2023.

With regards to communication of the order passed in the appeal, the same collected from the office of the Appellate Authority on 04.09.2023 by one Mr. Harbir Singh, Advocate for the Petitioner before the Appellate Authority. The contact number of Mr. Harbir Singh, Adv. as mentioned by him in the written receival confirmation is 9717207165. Further the copy of the above said order dispatched to the address of the appellant on 30.08.2023. The copy of order also uploaded on the website:

www.erevenuecourt.delhi.gov.in.

In light of the above, it is stated that the present petition is devoid of merits and liable to be dismissed.

In terms of the above status report, the Petitioner's counsel, who had represented her before the Appellate Authority, has received the copy of the final order of the Appellate Authority. It is further pointed out that the said order was also uploaded on the website: "www.erevenuecourt.delhi.gov.in". 5.

In light of the above and considering the Petitioner's apparent lack of interest in pursuing the present petition, the Court is of the opinion that no further directions are required to be passed in the present matter. 6.
