% 16.02.2018 Learned counsel appearing for the defendant on instructions from Mr.Kuljeet Singh Wadhwa/defendant No.1, who is present in court in person, states that the defendant is not using the impugned trademark ZOHAR and shall not in future use the trademark ZOHAR. The defendant shall also withdraw their application No.3703193. He further confirms that the defendant is only using the trademark ZOHARA. Taking the above submissions of the defendant on record and binding the defendant to the said statement, present suit is disposed of.
