The petitioner has filed the present petition, inter alia, praying that FIR No. 223/2019 under Section 67 of the Information Technology Act, 2000 and all proceedings emanating therefrom, be quashed. 2.

The said FIR was lodged at the instance of respondent no.2. She had alleged that her Instagram account had been misused and her photograph had been posted online.

The petitioner as well as respondent no.2 are present in Court. The petitioner is identified by his counsel and respondent no.2 is identified by the IO. The petitioner and respondent no.2 state that there was some misunderstanding, which has since been amicably resolved. They confirm that they have voluntarily entered into a Settlement Agreement dated 14.08.2019.

Respondent no. 2 states that she had filed the said FIR under a belief that some unknown person had posted the photograph in question online. She has since become aware that the same was done by the petitioner who happens to be a friend of her. She states that she does not wish to pursue the said FIR and joins the petitioner in praying that the present FIR be quashed. 5.

In view of the statement made by the petitioner and respondent no.2, the petition is allowed. FIR No. 223/2019 under Section 67 of the Information Technology Act, and all proceedings emanating therefrom, are quashed.

The petitioner and respondent no.2 shall sign this order as an acknowledgment of the statements recorded herein. 7.

The petition is disposed of.
