% 18.11.2019 The respondents have filed their counter-affidavit. Along with the same, they have placed on record, the circular dated 09.09.2019 on the subject of relaxation of time for seeking compounding of offences, inter alia, under the Income Tax Act.

Learned counsel for the petitioner states that the petitioner would avail of the benefit of the said circular and the respondents may consider the petitioner's application for compounding of offences. Accordingly, this petition is dismissed as withdrawn with liberty to the petitioner to make an application to seek compounding in terms of the circular dated 09.09.2019. If the application is made, the respondents should

consider the same in the light of the said circular. Dismissed as withdrawn.
