IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 2383/2019 KAILASH DEVI & ORS ..... Petitioners Through:

Mr Santosh Pratap, Advocate.

versus GOVT. OF NCT DELHI & ORS ..... Respondents Through:

Mr Rajesh Mahajan, ASC for State.

SI Islamuddin, PS Anand Vihar.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 27.08.2019 1.

The petitioners have filed the present petition, inter alia, praying as under:- "a.

Issue direction to the respondent state of NCT Delhi to protect the life and liberty of the petitioners; b.

Restrain the respondents no.2 to 5 from threatening /harassing to the petitioners."

2.

This petition arises in the context of the allegation that respondent nos.1, 2, 3 and 5 had assaulted the petitioners. A FIR of the said incident has also been lodged at the instance of the respondents. A cross FIR, at the instance of the petitioners, has also been lodged. 3.

The learned counsel appearing for the petitioners states that a cross FIR has been lodged but the correct provisions of law had not been noted. He also states that the respondents are threatening the petitioners.

4.

This Court is not inclined to entertain the present petition. In the event, the petitioners are aggrieved on account of the said FIR not recording the current offence, they are at liberty to approach the concerned court. 5.

Insofar as the petitioners' contention that they are being victimised is concerned, this Court is refraining from making any observations. Suffice it to state that this Court finds no reason to believe that the police authorities shall not conduct a proper inquiry in regard to the FIRs that have already been lodged.

6.

The petition is, accordingly, disposed of.
