The petitioner has filed the present petition, inter alia, praying that parole granted to the petitioner, in FIR No:136/2008 u/s 376(2)(g)/328 of the Indian Penal Code, 1860 registered at P.S. Tilak Nagar, be extended for a further period of two months.

The petitioner has sought parole on the ground that his children are facing certain health problems and his wife is not in a position to take care of them.

The petitioner has also filed the Out Patient registration Card (OPD Card) of his daughter.

The respondent has filed the status report, which indicates that an inquiry had been conducted from the neighbours of the petitioner and it is found that both the children of the petitioner are suffering from fever but they have since recovered. It is also reported that the petitioner's son has also resumed going to school. Insofar as the petitioner's daughter's OPD Card is concerned, it is stated that the patient did not come up for a follow up as advised.

In view of the aforesaid report, this Court does not consider it apposite to extend the parole granted to the petitioner. 6.

The petition is, accordingly, dismissed.

The petitioner is directed to surrender to the jail authorities by the end of the day.
