% 27.08.2019 Crl.M.A. 34347/2019 (Exemption) Allowed, subject to all just exceptions.
This application is, accordingly, disposed of. BAIL APPLN. 2135/2019 Vide the present application, the petitioner seeks bail in case FIR No.173/2019 registered at Police Station Jafrabad, Delhi for the offences punishable under sections 302/201/202/203 IPC. The present petition is filed on the ground that the son of the petitioner is going to be married on 28.08.2019 and Valeema (reception) is scheduled to be held on 31.08.2019.
The factum of the marriage and reception has not been disputed by learned APP, however, he has opposed the present petition on the ground
that the petitioner has murdered second wife and marriage is of the son of first wife. He further submits that son of the second wife is the prosecution witness in the case, therefore, there is apprehension that the petitioner may influence prosecution witnesses while on interim bail. Keeping in view the facts and circumstances of the case as narrated by learned APP, this court directs the jail authorities to allow the petitioner to attend Nikah(marriage) of his son to be held on 28.08.2019, between 08:00 p.m. to 10:00 p.m. under the custody and thereafter he shall be brought back to the concerned jail. The Jail Superintendent is further directed to allow the petitioner to attend Valeema (reception) to be held on 31.08.2019 between 08:00 p.m. to 09:00 p.m. and thereafter he shall be brought back to the concerned jail.
In view of above terms, the application is accordingly allowed and disposed of.
Order dasti.
Copy of this order be transmitted to the Jail Superintendent and the Trial Court concerned for compliance.
