O R D E R
% 06.02.2018 FIR No. 256/2013 was initially registered under Sections 287/337 against the petitioner at police station Mayapuri on the complaint of respondent no.2. During investigation, offence under section 337 IPC was converted to 338 IPC as injuries were opined to be grievous. Respondent no. 2 was working in small scale factory of petitioner where he sustained injuries while working on a machine.
Respondent no.2 is present in the court and has been identified by ASI Rohtash Kumar of police station Mayapuri. Respondent no.2 submits that he has settled the matter with the petitioner of his own free will and without any undue force, pressure or coercion, therefore, he has no objection in case FIR is quashed.
Keeping in view the settlement arrived at between the petitioner and respondent nos.2 voluntarily, in the interest of justice, FIR No.256/2013 under sections 287/338 IPC registered at police station Mayapuri and the
consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
