By way of present petition, the petitioner is aggrieved with the order dated 29.08.2022 passed by learned MM/ND/RAC/Delhi whereby cost of Rs.3,000/- was imposed upon the petitioner per complaint case for the reason that an adjournment was sought on the ground that the main counsel was held up in other court.

A reading of the impugned order would show that the learned Trial Court imposed a cost of Rs.3,000/- on account of the fact that repeated adjournments were sought on behalf of the petitioner who was summoned as an accused in the proceedings initiated under Section 138 NI Act. A further reading of the impugned order would show that even earlier the petitioner was saddled with cost of Rs.1,000/- on 07.04.2022 and cost of Rs.2,000 on 28.04.2022. Despite aforesaid imposition of costs, the petitioner continued to seek adjournment. costs vide the impugned order. Even in the present petition, notice was directed to be issued on 05.09.2023 and thereafter the matter has been listed but office noting would show that the process fees was filed only once which also remained under office objection.

For all of the aforesaid reasons, I find that the petitioner has scant regard for the court proceedings and has repeatedly sought adjournments thereby delaying the trial. No ground is made out to entertain the instant petition and the same is accordingly dismissed along with pending application.
