The appellant is aggrieved by order dated 09.05.2024 whereby her application moved under Order XXXIX Rules 1 and 2 read with Section 151 CPC has been dismissed.

After hearing arguments for some time, learned counsel for the appellant states that he may be permitted to withdraw the present appeal with the direction to the learned Trial Court to expedite the disposal of the suit.

Keeping in mind the aforesaid statement made by the learned counsel for the appellant, the present appeal is dismissed as not pressed. 4.

The learned Trial Court is, however, requested to make best endeavour to dispose of the case as expeditiously as possible. 5.

Needless to say, both the sides would render due assistance and cooperation to the learned Trial Court in this regard. 6.
