This appeal has been filed by the appellant challenging the Order dated 15.04.2004 passed by the learned Single Judge of this Court in W.P.(C) 8459/2019, titled M/S Kunal Enterprises (Regd.) v. Dheeraj, by which the learned Single Judge has dismissed the CM APPL. 22014/2024 filed by the appellant herein seeking extension of time for depositing the amount as directed as a pre-condition for stay of the Industrial Award dated 28.02.2019.

None appears for the respondent.

This Court, vide its interim Order dated 31.05.2024, taking into account the submissions made by the learned counsel for the appellant regarding the reasons for delay in making the deposit, had directed as under:

"Subject to the appellant depositing within six weeks the sum of Rs 4 lakhs with the Registrar General of this Court alongwith interest @6% p.a. w.e.f. 25.09.2023 i.e. the date when the LPA 466/2024 Page 1 of 2 Signed By:PRIYADARSHANI JAIN 16:48:39

appellant was granted four weeks further time to deposit the same, the operation of the impugned order will remain stayed till the next date. Consequently, subject to this deposit, the impugned industrial award will also remain stayed, till the next date."

The learned counsel for the appellant submits that the appellant has duly deposited the directed amount with the Registrar General of this Court.

In view of the above, the Impugned Order dated 15.04.2004 is set-aside, and the Interim Order dated 31.05.2024 is made absolute during the pendency of the above Writ Petition. 6.

The appeal along with the pending application is, accordingly, disposed of in the above terms.
