% 15.02.2018 Respondent no.2-Baby Ishika is aged about 3 years, thus, she is being represented through her father, namely, Rajesh Kumar. It is submitted that while driving his motorcycle petitioner hit Baby Ishika who was playing on the road resulting in simple injuries to her. Petitioner is neighbour of respondent no.2.

Petitioner and respondent no.2's father have settled the matter amicably before the Delhi Mediation Centre, Dwarka Court, New Delhi on 20th January, 2018, therefore, FIR No. 786/2016 under Sections 279/337 IPC of police station Uttam Nagar may be quashed. Mr. Rajesh Kumar is present in Court and has been identified by SI Satyawan of police station Uttam Nagar.

He submits that he has settled the matter with the petitioner of his own free will and without any undue force, pressure or

coercion, therefore, he has no objection if the FIR is quashed. Photocopy of the settlement proceedings of Mediation Centre has been annexed as Annexure C.

Keeping in mind the facts and circumstances as detailed above, I am of the view that no fruitful purpose would be served to keep the proceedings pending. Accordingly, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed.

Petition is disposed of in the above terms.
