% 07.09.2016 The appellant has challenged the award of the Claims Tribunal on the ground that the deceased was a passenger of Maruti Alto car and, therefore, not entitled to the compensation.

This appeal has become infractuous in view of the judgment of this Court in Yashpal Luthra v United India Insurance Co. Ltd., 2011 ACJ 1415 in which all the insurance companies had admitted the liability in respect of the passengers of the car under the comprehensive policy. The insurance companies also undertook to withdraw all such pending appeals. This appeal is, therefore, dismissed as infructuous.

Pending applications are also dismissed.

Learned counsel for the claimants submits that the appellant has deposited the award amount with the Claims Tribunal and the same has been disbursed.
