The present petition under Section 482/483 of the Code of Criminal Procedure, 1973 („Cr.P.C.‟) has been filed by the petitioner seeking setting aside of the order dated 05.08.2023, passed by learned Additional Sessions Judge, Special Judge, PC Act, Rouse Avenue Court, New Delhi, in CC No. 59/2022, titled "CBI Vs.

Lalu Prasad", arising out of RC 220/2022/E/0007/EO-II/CBI/New Delhi.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is seeking statements of LW-2 and LW-13, recorded under Section 161 of Cr.P.C., during the investigation. It is submitted that the said statements have been relied upon by the CBI in their charge-sheet, thus the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. same needs to be supplied to the petitioner, in accordance with Section 207 of Cr.P.C.

Learned counsel appearing on behalf of the CBI submits that one more supplementary charge-sheet will be filed by the CBI before the learned Trial Court. It is also submitted that the petitioner will be supplied with the statements of LW-2 & LW-13, as prayed for, in the present petition, before arguments on charge commence, in the learned Trial Court. Learned counsel for CBI states that the same shall be provided before arguments on charge commence before the learned Trial Court.

In view of the statement made by learned counsel for CBI, the present petition stands infructuous and accordingly disposed of. Pending application also stands disposed of.
