The present petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is directed against order dated 28th November, 2024, whereby the Petitioner's request for grant of furlough has been denied by the concerned jail authorities.

The Petitioner is a convict serving life sentence in FIR No. 221/2010, P.S. Rajori Garden, under Sections 302/392/404/34 of Indian Penal Code, 18601.

As per the impugned order, the rejection of the Petitioner's request for furlough is primarily premised on the ground that the Petitioner had previously violated the conditions of release while on emergency parole. 4.

After hearing the submissions of both parties, the Court is of the opinion that, given the significant time that has elapsed since the passing of the aforementioned order, the Petitioner must submit a fresh application to the concerned Jail Superintendent. It is directed accordingly. As and when such an application is filed, it shall be considered within the time frame stipulated under the Delhi Prison Rules, 2018. 5.

It is further clarified that, in the event the outcome of the application is adverse to the Petitioner's interests, he shall be at liberty to assail the decision, in accordance with the law.

The Court has not examined the merits of the case. All rights and contentions of the parties are left open.

The petition is disposed of.
