The appellant has assailed order dated 14.05.2025 of learned Addl. Sessions Judge passed in the revision proceedings, thereby upholding order dated 16.07.2024 of the learned trial Magistrate under Section 156(3) CrPC. 3.

Broadly speaking, the circumstances relevant for present purposes are that the present respondent lodged a complaint alleging that she had purchased a car in her name but the present appellant (husband of the respondent) forged her signatures and got the registration of the car transferred in his name. The learned Magistrate, after examining the Action Taken Report opined it necessary to unearth evidence through forensic analysis and that the complaint prima facie discloses cognizable offence, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. directed registration of FIR. That order of the learned Magistrate was assailed by the appellant in revision proceedings and the same was upheld by the Court of Sessions. Now, the appellant has filed the present appeal invoking provisions under Section 374 CrPC.

Learned counsel for appellant after arguments seeks permission to withdraw this appeal with liberty to institute appropriate proceedings in accordance with law.

The appeal and the accompanying applications are dismissed as withdrawn with liberty as sought.
